Mission Statement
Based on its United States Patent, Clearly-Protected will research, design, develop, test, manufacture, market, sell, deliver and warranty the telescoping hurricane shutters with confidence that they are safe and architecturally compatible with the home or business and have passed stringent ASTM & TAS standards such as those required by Miami-Dade, State of Florida, International Building Code and the Texas Insurance Commission.
SALES TAX
Clearly-Protected charges sales tax as required by the State of Florida and Volusia County. If the shutters are being used outside of Florida and shipped there, we do not charge sales tax. If your state has a sales tax it is your responsibility to pay. In Florida, certain counties (other thanVolusia) have imposed an additional sales tax, which we do not collect and you should check with your county to determine your responsibility, if any.
TWO YEAR LIMITED WARRANTY
The warranty covers any material defect in workmanship or material components in the manufactured product for two (2) years from the original date of purchase. The owner shall notify the dealer from which the product was purchased or Clearly-Protected LLC specifying the defect.
Clearly-Protected LLC, warrantor, agrees to repair or replace, at its option, any part which is found to be defective during the warranty period. The warranty does not apply to damage resulting from abuse, Act of God, fire, wrong size, improper cleaning or maintenance, accident, natural disaster, alteration, improper installation, improper operation or repair of the product by anyone other than a representative authorized by Clearly-Protected LLC.Owner shall be responsible for providing normal care and maintenance as provided in the owners handbook and making the product reasonably accessible for warranty inspection and work. If the product or one of its component parts contains a defect or malfunction during the warranty period, after a reasonable number of attempts by the warrantor to remedy the defect or malfunction, the owner is entitled to either a refund of the purchase price or replacement of the product at the warrantor's option.
Warrantor's liability on any claim of any kind, with respect to the product covered, shall in no case exceed the price of the product that gave rise to the claim. All costs of removal and reinstallation of the products are the express responsibility of the original user / purchaser.
Data Sheets and Supplier Warranties of component parts used by Clearly-Protected LLC in its manufacture and assembly of hurricane protection are included with this warranty and are incorporated herein by reference. If this Limited Warranty is silent regarding any particular issue, then the appropriate manufacturer's warranty shall be the controlling document. The warranty is voided if the product is not purchased from Clearly-Protected LLC or one of its authorized dealers. For breach of any written express or implied warranty on this product, the purchaser is limited exclusively to the remedies provided in this limited warranty. In no event shall Clearly-Protected LLC be liable for consequential or incidental damages. Some states do not allow the exclusion or limitation of incidental damages so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
RETURNS
Clearly-Protected products may only be returned due to a defect in manufacturing. In such instances, Cleary-Protected will replace the item at no charge. All returns must be approved in advance. Please contact customer Service before returning any products.
ESTIMATED SHIPPING CHARGE
Shipping costs are a "moving target", but Clearly-Protected has determined a fixed charge depending on your location and we will absorb any difference from what we show on your order and that which we have to pay.

HOW TO HANDLE SHIPPING DAMAGE
Unfortunately damage to products shipped can happen from time to time. A satisfactory resolution to a damage claim varies with your actions when the delivery is made. The shipper, when delivering, will ask you for a signature verifying that all of the products we have sent you are received in good order. Therefore, you must inspect the items you are signing for before you sign for the products. If you see any damage to the box or anything that would reasonably indicate damage, it must be noted on the delivery receipt. If the product is damaged, we suggest that you refuse the shipment and contact the local shipping manager. As soon as the shipping manager contacts us (or you do) we will give priority to your replacement request.
If you do not note the possibility of damage on the delivery receipt, you will find it very difficult to obtain any relief from the shipping company should you have damage that was not noted on the receipt. If you have any concerns about damage, we suggest that you call the shipper's local terminal and speak to the manager about your concerns before the driver leaves.
Clearly-Protected is not responsible for shipping damage. The shipping company is responsible for shipping damage.
If you sign for a delivery that is damaged, you accept all responsibility for the shipment and any damage that may have occurred during the shipping of your goods.
